Terms of Service

These terms form a binding agreement between A Unit of Knovedad PVT LTD, A private limited company incorporated under the Companies Act, 2013, with its registered office at K-22, Lower Ground Floor, Near Vijay Sales, Lajpat Nagar, New Delhi - 110024 (“we”, “us”), and the business that opens an account on BuySure (“you”, “the Business”). By creating an account or using the app you accept them. If you are accepting on behalf of a company, you confirm you are authorised to bind it.

1. What the service is

BuySure is software that lets a business record its purchase of pre-owned goods — mobile phones, laptops, tablets, home appliances, and other consumer electronics — from a customer: capturing the customer's details and identity document, photographing the item, recording the payment, generating a purchase invoice, and — where enabled — verifying the identity document and collecting an electronic signature.

2. Eligibility and accounts

• You must be a lawfully registered business, and the individual using the account must be 18 or older.
• Account details you give us — business name, address, GSTIN, CIN, contact details — must be accurate and kept current. They are printed on the invoices the app generates.
• You are responsible for everything done under your account, including by your staff. Keep credentials confidential and tell us immediately at info@cashforphone.in if you suspect unauthorised access.
• We may suspend an account pending verification, or refuse to open one, at our discretion.

3. Your obligations to your customers

This is the most important section of this agreement. When you record a customer in BuySure, you are the Data Fiduciary for that person's data and we act only as your processor. You therefore agree that:

• You will obtain the customer's free, informed and specific consent before capturing their identity document or photograph, and you will tell them what it will be used for.
• You will display or make available your own privacy notice to the customer.
• You will collect only what the transaction genuinely requires, and will not record a purchase from anyone under 18.
• You will not upload any document or photograph you are not entitled to hold.
• You will respond to a customer who asks about their data, and will cooperate with us if such a request reaches us instead.
• You will comply with the Digital Personal Data Protection Act, 2023 and every other law that applies to your trade, including any registration required to deal in pre-owned goods.

You indemnify us against any claim, penalty or loss arising from your failure to do these things.

4. Acceptable use

You may not use BuySure to:

• Create false, fabricated or backdated records, or verify a document that does not belong to the person present
• Record dealings in stolen, counterfeit or unlawfully obtained goods
• Run identity checks for any purpose other than a genuine purchase you are recording
• Resell, sublicense or white-label the service without our written agreement
• Reverse engineer, scrape, load-test or attempt to access another account's data
• Bypass wallet charges or interfere with the service's operation

Breach of this section may result in immediate suspension without refund.

5. Wallet, charges and refunds

• The service runs on a prepaid wallet. You top it up in advance and we deduct a fixed charge for each chargeable action — identity verification and electronic signature — at the rates shown in the app when the action is performed.
• A charge is incurred when we call the third-party provider, and applies whether the verification returns a positive or negative result. A negative result is a service delivered, not a failure.
• Where a call fails because of an error on our side, we credit the amount back to your wallet.
• Wallet balances are non-refundable and non-transferable. They carry no interest and cannot be withdrawn as cash.
• We may revise rates on 30 days' notice. Continuing to use the service after that is acceptance of the new rates.
• You are responsible for taxes on your own transactions. Charges are exclusive of GST unless stated otherwise.

6. Verification and electronic signature

Identity verification and e-signature are delivered through licensed third-party providers. We pass on what those providers return; we are not the verifying authority and we do not warrant that a result is correct, complete or current. A verification result is one input into your own judgement — it is not a substitute for checking the physical document and the person in front of you.

Electronic signatures collected through the service are executed under the Information Technology Act, 2000. You are responsible for satisfying yourself that the signature method suits the document you are having signed.

7. Documents the app generates

The app produces a purchase invoice and, where used, a signed agreement, from the data you enter and the details on your account. You are responsible for the accuracy of that data and for confirming the generated document meets your legal and tax requirements. We provide the template; we do not give legal or tax advice.

8. Availability

We aim to keep the service running but do not guarantee uninterrupted availability. We may take it down for maintenance, and features may depend on third-party services outside our control. We are not liable for downtime caused by a provider, a network operator or an event beyond our reasonable control.

9. Intellectual property

The app, its interface, code and documentation belong to us. We grant you a limited, non-exclusive, non-transferable, revocable licence to use them for your own business while your account is in good standing. Data you enter remains yours; you grant us the licence needed to host, process and display it in order to run the service. Your logo may appear on documents the service generates for you.

10. Suspension and termination

• You may stop using the service at any time and ask us to close your account.
• We may suspend or terminate an account that breaches these terms, that we reasonably suspect of fraud or illegality, or where required by law.
• On termination, your licence ends and access stops. You may request an export of your records within 30 days; after that we may delete them subject to the retention rules in our Privacy Policy.
• Any remaining wallet balance is forfeited on termination for breach.

11. Disclaimers

The service is provided “as is” and “as available”. To the extent the law allows, we exclude all implied warranties including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be error-free or that results obtained through it will be accurate.

12. Limitation of liability

To the extent the law allows, neither party is liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, goodwill or data. Our total aggregate liability arising out of or relating to the service is limited to the amount you paid us in the three months preceding the event giving rise to the claim.

Nothing here limits liability that cannot lawfully be limited, including for fraud.

13. Indemnity

You will indemnify and hold us harmless against claims, damages, penalties and reasonable legal costs arising from your use of the service, your breach of these terms, your handling of customer data, or a dispute between you and a customer.

14. Changes to these terms

We may update these terms. Material changes will be notified in the app or by email before they take effect, and the date at the top will change. Continuing to use the service after the effective date means you accept them.

15. Governing law

These terms are governed by the laws of India. The courts at Delhi, Delhi have exclusive jurisdiction over any dispute. Before filing, both parties will attempt to resolve the matter in good faith within 30 days of written notice.
